if someone is beating you up and you have a gun,do you have a right to shoot them?

    if someone is beating you up and you have a gun,do you have a right to shoot them?

    even if they are unarmed?? if you are losing a fight do you have the right to kill someone now?

    yes.

    but not if you're the ****** who started the fight.


    he started a fight with you , you are losing..... you shoot him = self defense

    you started a fight , you started to lose..... you shoot him = manslaughter at minimum

      Different laws in different states. In Jersey you couldn't do that I believe. I believe there's a law where both parties must be equal, if I have a gun and you have a knife, and I shoot you, I can get charged for murder.

      Also, I can't shoot you in the back incase you start running.


      But to answer your question, if you started attacking me and I had a gun, best believe I'm going to put you away.

        so a guy breaks in your house and threatens you with a knife , you can't shoot him?

        that's dumb.

          In Britain no, because the law prevents me from having a gun.

          In America maybe. If I'm getting beat up and feel under threat, it's awfully temping to use the most effective method of protecting yourself.

          So yes, if the law in America dictates that you can own a gun, and more importantly, carry it in public, then yes, people can't act horrified when you decide to use it.

            Ithink so. If someone starts a fight with me & is kicking my a$$ & I have heat, I'm killing you.

            However when someone goes out of their way to instigate a scuffle, they should not have that right.

              Once you start doing something with excessive force (kicking/stoping while on the ground, bashing their head on the ground, etc.) then hell yea. Unarmed does not mean incapable of serious damage/death.

                Not necessarily. . . Like Pepe said, different states have different statutes; the language of some of the "stand your ground" statutes are nebulous enough to where the "attacker/victim" roles could switch during the fight.

                EX: Lets say you come up to somebody, and swing on them. . . You hit them, and then they hit you back and knock you down. . . At this point, no, you couldn't shoot them. . . However, lets say they then proceed to reign down boots, fists, and elbows upon dat ass as you are down. . Or, in this case, you mount the person and proceed to smash their head in the ground over, and over, and over again. . . It would very well be possible for the initial aggressor to be acting in self defense by shooting the guy.

                  I believe so, but I would have to look it up to be 100% sure.

                  Jersey has really ****ty self defense laws from what I hear.

                    As long as somebody is doing something that would make a reasonable person believe they are at legitimate risk of "loss of life or limb", they could use deadly force (a gun). . .

                    So if somebody is really beating the shyt out of you, and you are in a helpless/defenseless position, then shooting them would be justified. . .

                    It works on an ad hoc basis; situations are very fact specific in regards to when it's justifiable to shoot somebody (or use any kind of retaliatory deadly force). . .
