Either way, prove it beyond a reasonable doubt. Floyd was complaining that he couldn't breathe while wrestling the cops to stay out of the cop car, before he was ever put to the ground, on his chest. Did the cops have a knee to him when they were trying to get him into the car?...........Rockin'

That's what the prosecution is going to do, and has been doing thus far.

Hmm. I haven't looked into the judge. My guess is that he won't diverge from sentencing guidelines, which would mean 12.5 years for either murder charge. But I'm holding out hope that if Chauvin is found guilty of 2nd degree murder, which is what I feel he should be found guilty of, that the judge will see his crime as so heinous (as it was) that he will throw the book at him for something above the 12.5. He can give him as much as 40 years, from what I understand.

I can't imagine him getting off free or getting off only with manslaughter, but imagine if he only gets 3rd degree murder, knowing that the charge was almost dismissed before they began. That would mean that he'd be close to getting off with no murder charge, and possibly off completely free if they don't go with manslaughter. The only reason they reinstated the 3rd degree murder charge is because that's what they used when the white woman was killed by the black ****** cop, so they couldn't ignore the precedent.

I wonder how much latitude state judges in MN have to depart from guidelines.

Chavin rafter he’s convicted will meet with court appointed people who will get his whole history and make sentencing recommendations to the judge. Ultimately the judge can depart from those recommendations, but he’ll have to justify why.

I don't think he's getting off either. But I also don't think that the judge will depart from the guidelines. I'll reluctantly accept 12.5 years of that piece of shlt being off the streets.

He couldn't breath and to make sure he wasn't faking Chavin strangled him. Is that what you are getting at. Or was he so concerned about Floyd's welfare that he applied his own version of first aid.
