The system needs to be overhauled.
But I think there should be death penalty reserved for the most henious, odious, and violent of crimes. Including treason that results in the death of many.
They system in America is crap but do you know any countries where you feel the capital punishment actually have a good system? What can USA learn from those countries?
You have many cases where people been wrongly convicted of murder and after spending 10-20 years behind bars for a homicide they didn't commit finally been released. Yes, they are free to go but the corrupt judicial system took away many years of their life. Not everyone is that lucky. I'm just talking about using capital punishment "in theory." If there was a way it oculd be worked out where people who are found guilty by a jury of their peers would be subject to execution IMMEDIATELY. Give them an appeal, and then that's that.
And where the family of the victim has a huge input and voice on whether or not they would like the perpetrator to be executed.
There's definitely a way it could be set up...
As far as innocent people getting convicted? Yeah, sadly, that'll always happen. No matter how perfect of a system you have. However, the amount of people who are falsely convicted are EXTREMELY rare. One is too many, but still, I do believe that the system of justice to determine guilt or innocence used by USA, is the best in the world.
But the way I envision the death penalty being used - is where ONLY when there is a "certain level" of evidence (must even be beyond the required threshold to convict somebody "beyond a reasonable doubt.") I'm talking about DNA evidence, the most damning circumstantial evidence (contrary to popular belief - some circumstantial evidene can be just as damning, if not more so, than physical/DNA evidence.)..

pedophilia - i mean its not like they are gonna stop wanting to have *** with kids. if you let them out kids will always be at risk. they will never change their ***ual predilection.
serial killers - unless they are reaaaally cool hannibal lecter level where we can learn information from them to improve our psyche profile etc..
terrorism - wayyyyyyy too many *********s alive in supermax prisons.
gruesome heinous crimes like those home invaders in the east coast who ****d and murdered a mom and daughter by strapping them into a bed and setting them on fire. women like andrea yates.
