                  We call what the paramour did tortious interference by criminal conversation. His knowing and intentional actions caused to her to breach the contract. That said, it must be noted that not all jurisdictions allow for this type of recovery. In fact it's very few.

                  Addendum: Her negligent actions in relation to the marital contract would be addressed in the subsequent cause based divorce and property settlement agreement

                      His impotency could be raised as a grounds for divorce, but not as a defense to Infidelity.

                      And if I remember the lecture correctly, that law is one that is retained from the English common law system, but I'm not 100% certain on that.
