The thing with proving it was an intentional felony assault, is that with the outcome taken out of the equation, is it still a felony assault? Right or wrong, cops do this type of thing all the time, being over exuberant with restraint techniques etc. The most egregious part was how long he stayed on there and even after it was clear the threat was subdued/Floyd appeared unresponsive. Take that out of the mix and I doubt any cop would be getting charged with felony assault for putting their knee on someone’s neck.

I will say that from the vantage point of the 3 officers restraining him, it may have been hard to assess Floyd’s condition. We got a view that they didn’t have. It was more negligence than willfully committing what he knew was assault imo. What was the cause of that negligence is another question...was it ignorance, power tripping, or “depraved mind”. The 3rd degree charge may be more compelling than the 2nd degree charge for that reason.

Yeah the third degree charge may be more compelling but the prosecution also has an obligation to charge him with what in their opinion suits his actions. Obviously they feel that a conviction of murder in the second degree is the proper charge and they have a duty to prosecute him.
