That is obviously correct, regardless as to his qualifications and Harvard background, Arum does not perform legal work for Top Rank. He is a boxing promoter, and he has a legal team that handles contracts, litigation, etc.

You are one of the very few on this subject who has common sense, and can see it when it appears. \The ignorance here is SO appalling that if it is a regular example of what's "out there", the human race is damned lucky that there is a class of thinkers and doers who really "look afer us" and prevent us from sinking into chaos and ultimate destruction.

I sent in a LONG letter and used "CAPS" on only 14 key words total. The reason is , exasperation with DUMBOS like YOU who can't see what's spelled out clearly although right in front of your noses. And that means the MAJORITY of the posters on this site.........as I said, and want to repeat, like YOU for instance. I quite even reading the posts sometimes for weeks at a time from sheer ennui, even disgust, but, being a true boxing enthusiast, I always come back.

I've been on this site for over 7 years and where it once was the very best, and most intellectually stimulating site on the whole Internet for boxing, it has deteriorated more and more, until we have the majority of ppsters like YOU, who can exercise your "freedom of speech" by showing your profound ignorance, and actually being PROUD of it.

In my previous response to you, I only read the first 2 lines before I answered. Now I have read , or actually just skimmed through more of what you have written and can answer more.

No I did not read the contract, i didn't need to I've made and read multitudes of contracts in my lifetime and know what can annd often does go into them. What Arum SAID was perfectly NORMAL to be in a contract, and in fact he'd be a damned fool if his contract did not contain at LEAST these minimum clauses.

And....NO, I would NOT do what Donaire did, I would NOT sign a contract with another entity when I had already an existing contract with.....say....Top Rank, , in place already. I woild have KNOWN, at the very time of signing the Top Rank contract, what was in it, and what I was OBLIGATED by law to do. And I would NOT make a damned fool of myself by ignoring it.

I'm almost certain. from what I have seen published about this matter that Top Rank has a valid and enforcable contract with Donaire until 2013, and there's NOTHING he can do to get out of it, unless he can show that Top Rank has made the contract UNENFORCABLE.

Even if Top Rank does not carry out every clause it agreed to, Donaire would STILL have to go to open court not only to prove that, but to also prove, TO A JUDGES SATISFACTION, that the "errors" top Rank made, were, bASED ON THE CONDITIONS IN THE CONTACT, sufficient to render the contract "Null and Void'.

If i was in Donaire's shoes iwould NOT do the same. I'd have to be a real fool to sign a contract with another promoter when I still had a valid, existing contract with and existing promoter, with ove 2 years to run.

I would get a lawyer, try to find, IN THE CONTRACT itself, some little flaw which might give me grounds to dispute that the existing contract was in fact valid, and be prepared to spend a fortune, and still be prepared to lose. As odds go, I WOULDN'T do it at all.

Another approach I might make is to appeal to Top Rank's "soft spot" and ask them to release me or allow me to pay them an indemnity in lieu of the remainder of the contract. AND, still be prepared to lose.

In fact, what I'd REALLY do, would to try informally to have my situation vis a vis my appearances on various promotions bettered, in discussions with top Rank officials, and just carry out my responsibilities embodied in my existing contract.

No I'm NOT a practicing lawyer, but I WAS a practicing lawyer for years. Long ago, before I went into an academic and later a professional life.. It's NOt just believing EVERYTHING Arum says, the point is that WHAT he says the judgrAGREES with, and Arum EMPLOYS practicing lawyers who's business is CONTRACTS.

EVERYTHING ARUM says in this matter is COMPLETELY believable, and I'd rather back HIM than an ignorant 23 year old fighter with no education, who actually SIGNED the original contract with top Rank.

And I'm not a fool.

I think Arum/Pac go hand in hand. Manny could just be like put him down and Arum would find a way to do it bottomline and vice versa. Manny and Arum have every right to not let Donaire on his undercards but what would be the reason why something couldn't be worked out to let Donaire showcase his talent atleast once on a Manny Pacquaio undercard? I think people are over looking the interview Arum gave about why Donaire cannot relate to his own people. There is something deeper going on with all this.

Me too bud... It blew my mind how he actually expressed the part about the undercards because I had always said the same thing. And for you all arguing about if its Manny's fault or not.... STOP FOR A SECOND AND THINK....... This is not the only situation going on like this in TOP RANK.... Juan Manuel Lopez is to Cotto as Donaire is to Manny Pacquiao. THIS is the reason I despise TOP RANK. There is absolutely no reason why Juanma shouldn't benefit from Cotto's exposure and vice-versa... Also no reason for Donaire not to benefit from Manny's and vice versa... All Juanma has received from Bob Arum are empty promises of a fight with Gamboa that from day 1 seem to have the "maybe next year" feel after 3 years of milking and waiting. Bob doesn't understand that fighters have to feel appreciated in order to keep them. Nonito has Mega-Star potential similar to DLH in the sense that he is Fil-Am like DLH is Mex-Am. Nonito has a huge following in the Fils and is American. His style is explosive and his nickname is "FLASH"!!!! What more could you ask for?!?!? Bob has some splaining to do...

Arum is the promoter, the buck stops with him.

But, as pointed out in my post above, GRUS may be correct in that there is more to this than meets the eye. It would be in Bob's interest to have Nonito on Manny's undercard, at least for say the Hatton/Cotto/Clottey fights, Clottey in particular..... he certainly would not be having this issue with Nonito right now if he tossed him a bone now and then, and Donaire would have received much more exposure.
