Of course they are. If he had pleaded guilty to the charge then it would have been three games only because he was caught hitting someone in the face but that was missed by the ref. He only said he would fight the charge because Fergie wanted him in the derby.

One thing has changed: Ferguson is showing City way more respect than he was six months ago. I think it's probably because we have surpassed Liverpool by some distance he now considers City to be the local rivals again whereas for the last few years it has been Liverpool.
