As far as releasing an actual video , I think it's ok because Floyd has only shown him talking. It's good for publicity and promotion

He comes out and accuses the guy of cheating, and says here, you need to take this test that isn't required by any sanctioning organization or state commission. Floyd broke the trust by secretly recording a private meeting which is illegal without the consent of the opposite party.

Clearly, the person recording isn't trying to be incon****uous positioning himself behind Floyd with a low-angle-shot, most likely taken with a cell phone camera. The person recording obviously has nothing to hide so why not record the footage while facing the couch for a less obstructive and better view?
