Press Release: NEW YORK- Justice Louis York of the New York State Supreme Court dealt a serious blow to Victor Conte's efforts to avoid paying the price for the outrageous lies he has continued to tell about Shane Mosley. Mosley has sued Conte for defamation based upon Conte's outright lies concerning Mosley's use of steroids.
In an effort to avoid reaching the truth, Conte tried the procedural gambit of seeking to dismiss the case for no merit. His efforts were met with a judicial slap in the face, as the Judge denied the motion orally without even feeling the need to write an opinion. As a general rule, only the most frivolous claims are dealt with in this manner.

Judd Burstein, Mosley's attorney, stated, "This is one step along the road of securing justice for Shane. Conte can run, but he cannot hide from me."
What's that mean? Have they been to court yet?

Isn't that article a Golden Boy press release?

Didn't Roger Clemens threaten to file a defemantion suit?

All the evidence is against him. Victor Conte has been right in everything he's told the feds about steroid use. Charts detailing Roidsley use were found and we have grand testimony of Roidsley admitting to using EPO and Anabolic steroids.

    Get over it. He cheated.

Lmao!! You're making assumptions. You have no clue whether he intentionaly juiced or not. If Conte is telling the truth, why is he trying to get the case dismissed instead of trying to prove he is telling the truth? If all the evidence is against Shane, as you claim, Conte should be looking forward to this court case. So far it doesn't seem like he is.

I would like to know more about this lie detector test. Who administered it? What questions were asked? If properly administered, the tests are supposed to be very accurate, but what do we know about who asked the questions and what they were?

Mosley has said that he didn't know they were illegal, and that he was assured that he wouldn't fail a drug test. Well he didn't test positive as BALCO specialized in making undetectable drugs. He, and many other athletes, could've just asked Conte "will this cause me to fail a drug test?". After being told no, they can claim "well I was told it wasn't on the banned substance list and I wouldn't test positive, so it's not illegal", even know they really know something shady is going on.

I think the lie detector test was administered by the feds, but don't quote me on that. If it turns out he knew what he was doing I'll call him a cheat too. But Im not just going to say he did to agree with the court of public opinion.

Boxer Shane Mosley is accused of using BALCO designer steroids "the clear" and "the cream" as part of a doping regimen before a 2003 fight against Oscar De La Hoya, SI.com reported Friday.
Citing multiple unidentified sources who attended an international anti-doping conference in Colorado Springs, last November, SI.com reported that lead BALCO investigator Jeff Novitzky alleged that Mosley began using those two drugs, as well as EPO, two months before the light middleweight championship fight won by Mosley.

A BALCO client, Mosley was subpoenaed in the Bay Area Laboratory Co-Operative investigation and testified before the grand jury in 2003. He had always denied doping and has never tested positive.

But Mosley on Friday confirmed that he had unknowingly taken some banned substances.

He said that his former strength and conditioning coach, Darryl Hudson, convinced him to take substances from BALCO, and that he unaware of what they were.

"Unknowingly, yes, some of the substances they are talking about, were being used as part of the workouts," Mosley told ESPN.com. "I didn't know what the (heck) it was.

"I didn't know anything about that stuff. It was something given to me, pushed up on me. I'm a health freak-type of guy. I like to have everything organic, natural."

He had said earlier Friday that he was upset that the matter had come up again.

"I'm disappointed that this is coming out again, four years after I've been to the grand jury and gave my truthful testimony," Mosley said in a statement issued by publicist Debbie Caplan. "I even took a lie detector test back then to let everyone know that I wasn't trying to be an unfair fighter."

According to SI.com, evidence seized during the BALCO raids showed Mosley had blood work done to measure his hematocrit level, the volume of red blood cells, at 44. In a calendar with his file, the date of July 26 was circled, accompanied by the word "start" and the letter "e," the website reported, and the boxer's level increased to 52.2 by Aug. 8.

"Most men are in the low 40s," Dr. Gary Wadler, a member of the World Anti-Doping Association, told SI.com. "Anything over 50 is considered off the charts."

According to that same calendar, Mosley received a final dose of EPO, which stimulates red blood cell production, on Sept. 8, five days before the fight, SI.com reported.

Victor Conte, the BALCO founder, was released from prison in March 2006 after pleading guilty to selling designer steroids.

"We went out there and I left him (Conte) a check for $1,500 with my name on it, and from then on I never saw him again," Mosley said Friday. "But from the beginning I had them contact the Nevada State Athletic Commission to make sure there were no problems. They got the banned substance list and I was told that nothing I was being given was on that list.
"I was upset because I didn't even need to go there," he said, meaning he didn't feel he needed any help for the matchup with De La Hoya. "I already felt that I was the better man and the better fighter. I wondered why I had to get in the middle of this type of scandal. It was kind of crazy and I felt used."

Blood doping has long been an issue in cycling and running, where athletes have boosted red blood cells to increase the capacity to carry oxygen to the muscles.

Mosley is scheduled to fight Miguel Cotto on Nov. 10 in a WBA welterweight title bout.

Mosley told Nedrow he thought the clear was actually flaxseed oil, a similar argument to the one used by Barry Bonds and other athletes who have been accused of using "the clear," before admitting that it was probably something else.

Nedrow: "Did they actually say it was flaxseed oil, or did they say: 'You can call it flaxseed oil?' What did they say about it?"

Mosley: "You're right, 'You can call it flaxseed - it flaxseed oil,' basically what they said."

Nedrow then goes on to say: "Okay. And I'm sorry. Let me clarify one thing. Because we've heard testimony that some people really thought it was flaxseed oil and some people said: 'Well, this is some stuff I have for you but we'll call it flaxseed oil.' If you know that difference."

Mosley: "Okay, okay. It was kind of like, you know (indicating) flaxseed, we'll call it 'flaxseed oil,' it's not - it's kind of like that (indicating) like you said."

                Nedrow: "Like - quotation marks."

Mosley: "It's (indicating) 'flaxseed oil,' but I believe it was probably - "

                Nedrow: "Something else?"

Mosley: "I guess it was something else, yeah."
